BOARD OF PUBLIC WORKS AND SAFETY/UTILITY BOARD

The regular meeting of the Board of Public Works and Safety/Utility Board was called to order by President Gary West at 10:05 a.m.  All members were present.  Mr. Prince moved to dispense with the reading of the minutes of May 31, 2011, and accept them as circulated.  Mr. Watson seconded; motion carried.

Mayor’s Comments:

Mayor Wood announced a brief staff meeting would follow today’s Board meeting.

 

Department Head Reports:

Building Commissioner Brock Hundt presented the Building Department statistics for the month of May, 2011.  He indicated permits were issued for Marian High School for a $500,000 alteration; more suites at University Commons Medical Plaza; and two (2) new single family homes for a total of fourteen (14) this year.

 

Interim Park Superintendent Tom Klaer requested the Board’s approval to award the bid for one (1) Trim Mower to Burris Equipment of Waukegan, IL, the lowest most responsive and responsible bidder, for the base bid of $25,574.00 less $2,250.00 for two trade-ins for a total award of $23,324.00.  Mr. Watson moved to approve as present.  Mr. Prince seconded; motion carried.

 

Human Resources Director Tara Antonucci requested the Board set a hearing date for Tuesday, August 2, 2011 at 11:00 a.m. in Room 106 for Grievance #10-01 and #10-02 with Teamsters Local #364.  Mr. Prince moved to approve as presented.  Mr. Watson seconded; motion carried.

 

Community Development Director Lory Timmer requested the Board award the contract for the demolition and removal of 413 and 421 North Cedar Street to R & R Excavating, the most responsive and responsible quoter, for the amount of  $94,910.00.  Mrs. Timmer noted for the record that R & R Excavating was the second lowest quoter.  Grade-Rite Excavating was the lowest quoter, but after reviewing Grade-Rite’s quote, it was determined that because of their lack of experience in large commercial demolitions, their limited staffing, and concerns about the permitting process involved in a demolition of this size, she was requesting to award the contract to R & R Excavating.  Mr. Prince moved to approve as presented.  Mr. Watson seconded; motion carried.

 

Mrs. Timmer requested the Board’s approval to receive quotes for the demolition and removal of 646-646 ½ Lincolnway East to be opened Tuesday, June 21, 2011.  Mr. Watson moved to approve as presented.  Mr. Prince seconded; motion carried.

 

City Planner Ken Prince presented a Professional Service Agreement with Lawson-Fisher Associates for St. Joseph River Floodplain Revisions for a not-to-exceed amount of $15,330.00 and moved for its approval.  Mr. Watson seconded; motion carried.

 

Mr. Prince requested the Board approve a Buy-Sell Agreement for 917 Grand Boulevard for $64,900.00 and moved for its approval.  Mr. Prince indicated the property is adjacent to Mary Gibbard Park and its purchase is contingent upon an appropriation from the Common Council.  Mr. Watson seconded; motion carried.

 

Approval of Claims:

There were no claims to approve.

 

Approval of SRF Payments:

There were no applications to approve.

 

New Business:

Mr. West said a request for a Transient Merchants License has been received from Sweet Corn Charlie Produce LLC to sell fruit and vegetables at the northeast corner of Hickory and Edison from June 15 thru September 30, 2011.  A public hearing has been set for Tuesday, June 14, 2011, at 10:00 a.m.

 

Mr. West said a request from Queen of Peace Catholic Church and School to host a three-day Parish Festival on Friday, August 26 thru Sunday, August 28, 2011 was taken under advisement.

 

A request from Yakety-Yak Café to block Center Street between Fourth Street and the alley to the south for a “Yakety Yak Café Summer Block Party” at 701 W. Fourth Street on Saturday, June 25, 2011 between the hours of 1:00 pm and 10:00 pm was reviewed by the Board.  Mr. Watson moved to approve this request subject to the standard conditions regarding public safety and noise control.  Mr. Prince seconded; motion carried.

 

A request from the Tilted Kilt located at 1032 University Drive to host a “Bike Night” with alcohol and food outside every Thursday from 5:00 p.m. to 10:00 p.m. was taken under advisement.

 

A request from Cross Bars Ministries to close Twelfth Street between Dodge and Union for two dates, Saturday July 23, 2011 between the hours of 8:00 a.m. to 3:00 p.m. and Saturday, August 6, 2011 between the hours of 1:00 p.m. and 5:00 p.m. was reviewed by the Board.  Mr. West moved to approve this request and asked that the City be named as an additional insured on the applicant’s insurance.  Mr. Prince seconded; motion carried.

 

Mr. West said a request for disabled parking has been received from the resident at 1017 Burdette Street.  This request has been reviewed by the Mishawaka Police Department’s Traffic Bureau.  Upon their review, the Police Department recommends that this application be approved.  Mr. Prince moved to approve the disabled parking request as presented.  Mr. Watson seconded; motion carried.

 

Mr. West said a request for disabled parking has been received from the resident at 211 Taylor Street and has been reviewed by the Mishawaka Police Department’s Traffic Bureau.  Upon their review, the Traffic Bureau recommends denial based on availability of off-street parking.  Mr. Watson moved to deny the disabled parking request for 211 Taylor Street.  Mr. Prince seconded; motion carried.

 

Old Business:

Mr. Watson moved to approve a request to close Hummel Street between Stickler and Brook on Saturday, July 9, 2011 from 11:00 a.m. to 10:00 p.m. for a block party subject to the standard conditions regarding public safety and noise control.  Mr. Prince seconded; motion carried.

 

Open Items:

Grievance Hearings #10-01 and #10-02 originally scheduled for February 22, 2011 have been rescheduled for Tuesday, August 2, 2011 at 11:00 a.m. in Room 106.

 

Mr. West indicated the hearing for Grievance 2011-1 filed by the Mishawaka Professional Firefighters Local #360 originally scheduled for April 26, 2011 will also be held on Tuesday, June 7, 2011 at 12:00 p.m. in Room 106.

 

A hearing for Police Dispatch Grievance 2011-1 has been scheduled for Tuesday, June 7, 2011 at 11:00 a.m. in Room 106.

 

Mr. West indicated the hearing for Grievance 2011-02 filed by the Mishawaka Professional Firefighters Local #360 pertaining to minimum suppression staffing strength as a result of 3rd ambulance has been tentatively set for June 7, 2011 at 12:00 in Room 106. 

 

Unfinished Business:

There being no additional business brought before the Board, the meeting was adjourned at 10:49 a.m.
