REGULAR MEETING OF THE MISHAWAKA
BOARD OF PUBLIC WORKS AND SAFETY/UTILITY BOARD
March 12, 2013

The regular meeting of the Board of Public Works and Safety/Utility Board was called to order by President Gary West. All members were present except Mr. Watson. Mr. Prince moved to dispense with the reading of the minutes of March 5, 2013, and accept them as circulated. Mr. West seconded; motion carried.

Bid/Quote Openings:

No quotes were received for Fire Sprinkler System Repairs at 700 S. Union Street.

Mayor’s Comments:
Mayor Wood announced a staff meeting would follow today’s Board meeting.

Department Head Reports:
Park Superintendent Terry Zeller submitted a request to remove one tree and stump in the right of way at 803 Grand Blvd. The tree has been analyzed and recommended for removal by the Park Department Landscaper. Mr. Prince moved to approve as presented. Mr. West seconded; motion carried.

City Planner Ken Prince on behalf of Street Commissioner Mike Watson requested the Board authorize the receipt of quotes for asbestos abatement at 700 S. Union Street for Central Services to be opened March 19, 2013, and moved for its approval. Mr. West seconded; motion carried.

Engineering Director Gary West requested the Board award the Wilson Boulevard Area Combined Sewer Outfall Consolidation project to HRP Construction, the lowest most responsive, responsible bidder, in the amount of $2,473,300.00, and moved for its approval. Mr. Prince seconded; motion carried.

Mr. West requested the Board accept a 30’ wide storm drainage overflow easement from Autumn Ridge Phase I basin to Dodge landfill site from Cleveland Woods Development, and moved for its approval. Mr. Prince seconded; motion carried.

Mr. West requested the Board approve plans and authorize the receipt of bids for West Street Storm Sewer Phase 1B (First Street-Front Street) to be opened April 2, 2013, and moved for its approval. Mr. Prince seconded; motion carried.

Approval of Claims:
There were no claims to approve.

Approval of SRF Pay Applications:
There were no applications to approve.

New Business:
A request from Bike the Bend to hold their annual family event on Sunday, May 19, 2013, using Riverwalk, Central, Merrifield, and Crawford Parks was taken under advisement.

A request from Tilted Kilt at 1032 University Drive for a Waiver of Noise Ordinance on Saturday, March 16, 2013, for live music in tent beginning at 6:00 p.m. until midnight, and Sunday, March 17, 2013, for DJ and live remote broadcast from 12:00 p.m. until 6:00 p.m. Mr. Prince moved to approve subject to normal public safety conditions and that live music end at 12:00 a.m. Mr. West seconded; motion carried.

Old Business:
Mr. West moved to deny the request from ABATE of Indiana to use Beutter Park for staging of their annual MDA motorcycle ride on Sunday, September 1, 2013, due to the site being inadequate for the event. Mr. Prince seconded; motion carried.

Mr. West moved to approve a request to use the Mishawaka Riverwalk for the Sunburst Marathon, 6:00 a.m. – 12:30 p.m., Saturday, June 1, 2013. Mr. Prince seconded; motion carried.

A request for Notice of Recognition of Encroachment submitted by Bethel College for installation of a directional sign on Lowell Avenue continued under advisement.

Administrative approval of Second Hand Store License Renewal received from Julie’s Used Appliances, 2302 Lincolnway West, continued under advisement due to previous building and zoning deficiencies identified on the property.

A request submitted by ASAP Towing Services for Towing Services Contract continued under advisement.

Unfinished Business:
There being no additional business brought before the Board, the meeting was adjourned at
