REGULAR MEETING OF THE MISHAWAKA
BOARD OF PUBLIC WORKS AND SAFETY/UTILITY BOARD
June 3, 2014

 

The regular meeting of the Board of Public Works and Safety/Utility Board was called to order by President Gary West at 10:01 a.m. Mr. Prince moved to dispense with the reading of the minutes of May 20, 2014 and May 27, 2014, and accept them as circulated. Mr. Watson seconded; motion carried.

Bid Opening:
Bids were opened for Cleveland Road Reconstruction (ENT 14-014) and are summarized below:

Mr. West said these bids would be forwarded to the consultant for their review, evaluation, and consideration.

Mayor’s Comments:
Mayor Wood read a letter from Leonard and Linda Kazmirski saying how much they appreciate the Mishawaka Memorial Day Parade and how moved they were by the show of support by the City’s dignitaries in the viewing stand.

Mayor Wood announced a staff meeting would follow today’s Board meeting.

Department Head Reports:
Chief of Police Ken Witkowski presented the Department’s submission of the 2014 Edward Byrne Memorial Justice Assistance Grant (JAG). The application is in the amount of $16,285.00 and is intended to be used for the purchase of law enforcement technology, equipment, and programs. Chief Witkowski indicated that as part of the application, they are required to advise the Board of the grant application. Mr. Prince moved to acknowledge the submission of the grant application as requested. Mr. Watson seconded; motion carried.

Park Superintendent Terry Zeller requested the Board approve closing various streets for “Summerfest” around Merrifield and Crawford Parks from 8:00 a.m. to 11:00 p.m. Saturday, June 28, 2014. Mr. Zeller also indicated the street closures are the same as in past years. Mr. Watson moved to approve as presented. Mr. Prince seconded; motion carried.

Mr. Zeller submitted a request to plant one tree in the right of way at 718 N. Wenger and 349 Park Avenue, and remove one tree and stump at 816 Lincolnway East. The trees have been analyzed and recommended for planting and removal by the Park Department Landscaper. Mr. Prince moved to approve as presented. Mr. Watson seconded; motion carried.

Engineering Director Gary West requested the Board approve plans and authorize receipt of bids for Mishawaka Avenue Improvements – Main to Cedar – to be opened June 24, 2014, and moved for its approval. Mr. Watson seconded; motion carried.

Mr. West presented Change Order No. 3 from HRP Construction for West Street Storm Sewer Phase II for an increase of $48,444.00 for a new contract price of $2,248,170.67, and moved for its approval. Mr. Prince seconded; motion carried.

Approval of Claims:
There were no claims to approve.

Public Hearing:
Mr. West opened the Public Hearing for Transient Merchants License application for LJ Concession to sell elephant ears at Powell Florist, 1215 Liberty Drive, from June 6 through June 8, 2014.

John Landrum, 330 W. Lawrence Street, appeared and said he has a trailer that he sets up. He also said he has set up in South Bend and at River Park Parade. He said he offers the elephant ears for less than they sell for at other places and wants folks in Mishawaka to have the opportunity to buy them.

Mr. West closed the Public Hearing.

City Controller Becky Miller asked if he has been inspected by the Health Department. Mr. Landrum said yes, and they will be out when they open.

Mr. Watson moved to approve the Transient Merchant License for LJ Concession to sell elephant ears at 1215 Liberty Drive from June 6 through June 8, 2014. Mr. Prince seconded; motion carried.

New Business:
A request was received from Montessori Academy at Edison Lakes to hold “Fall Frolic 2014” run/walk using Day Road and Windingbrook Streets on Saturday, October 18, 2014, from 6:30 a.m. to noon. Mr. Watson moved to approve. Mr. Prince seconded; motion carried.

A request from WSBT Radio Group in conjunction with Heritage Square to hold WNSN Bands on the Blacktop Party with three live bands, DJ, and tent to be held Saturday, June 28, 2014, from 2:00 p.m. to 1:00 a.m. was taken under advisement.

A request from Martin’s Supermarket for “Roof Sit 2014” at Martin’s Heritage Square from June 16, 2014 through June 20, 2014, with various activities to be held in tents and a “Port A Party” platform structure in their parking lot. Mr. Prince moved to approve “Roof Sit 2014” at Martin’s Heritage Square from June 16 to 20, and Waiver of Noise Ordinance for outside music, and also subject to Indiana State Fire Marshall inspecting the “Port A Party” platform structure and providing documentation to the Board, and other normal conditions of approval for public safety. Mr. Watson seconded; motion carried.

Old Business:
A request to close Clay Street between Jefferson Boulevard and Borley Street on Saturday, July 19, 2014, from 10:30 a.m. to 11:00 p.m. for a block party continued under advisement.

A Utility Board hearing set for Tuesday, June 17, 2014 at 1:00 p.m. in Council Chambers to hear a Utilities complaint appeal by Phillip Zwickl.

A request for Notice of Recognition of Encroachment submitted by Bethel College for installation of a directional sign on Lowell Avenue continued under advisement.

Public Comments:
Robert Doshi, 768 River Pointe Place, submitted a request to close the street for a neighborhood party on June 21, 2014. The request will be forwarded to all pertinent public safety departments for review.

Unfinished Business:
There being no additional business brought before the Board, the meeting was adjourned at 10:32 a.m.
